OSS registration too late: what applies now

Registered too late? The OSS registration normally starts on the first day of the quarter after you apply. If you crossed the 10,000-euro threshold, you can register by the 10th of the following month with the option "first supply"; after that, not retroactively (BZSt). For earlier sales, register in the countries of consumption and declare the VAT there (European Commission).

In short

  • Rule: The registration starts on the first day of the calendar quarter after the application (BZSt).
  • Threshold crossed: Register by the 10th of the following month ("erstmalige Leistungserbringung", date of crossing); never retroactively after that.
  • Gap: For sales before the start date, register in the countries of consumption and declare the VAT there (European Commission).

When does the OSS registration start?

The law requires that you notify your participation before the start of the tax period from which you want to use the scheme (§ 18j (1) UStG). The tax period is the calendar quarter. In practice the application runs electronically through the BZStOnline portal, and the registration starts on the first day of the calendar quarter after the application (BZSt).

The European Commission gives an example: a trader who tells the member state of identification on 15 February 2022 that they wish to use the scheme, and supplies the required details, can use it from 1 April 2022, for supplies made on and after that day.

What applies if you crossed the threshold?

The normal rule does not help if you cross the threshold in the middle of a quarter. For that there is an exception. The BZSt describes it like this: if you cross the 10,000 euro threshold within a quarter, you can register until the 10th day of the month following the month in which you crossed it. In the form you choose "first supply" (German form: "erstmalige Leistungserbringung") for the start of registration and enter the day you crossed the threshold as the date. On the threshold itself: the 10,000 euro threshold and distance sales under § 3c UStG.

The European Commission says the same in general terms: if you start supplies under the scheme before the regular start, you can use the scheme from the date of the first supply, provided you tell the member state of identification by the 10th day of the month following that first supply that you have started.

Two examples

Example 1, in time: you cross the threshold on 12 August. You register by 10 September, choose "first supply" and enter 12 August. The OSS applies from 12 August; the sales from then on belong in the OSS return for the third quarter.

Example 2, too late: same situation, but you register only on 15 September. The 10 September deadline has passed. The OSS then starts on 1 October. For supplies from 12 August to 30 September you must register in the countries of consumption and declare the VAT there directly (European Commission).

Both examples are calculations, not advice on an individual case.

What to do if the deadline passed

  1. Register now. An application in this quarter brings the start to the first day of the next quarter (BZSt).
  2. Clarify the gap. For supplies before the start date the European Commission names the route: register in the countries of consumption and account for the VAT there directly. How each country handles it follows its own law; ask a tax advisor. More on the distinction: OSS vs local VAT registration.
  3. Check German VAT. If German VAT was declared on those supplies so far, a correction may be needed. Clarify this with your tax advisor as well.
  4. File on time from the start date. The returns are due by 30 April, 31 July, 31 October and 31 January (BZSt); more in the OSS return guide.

Late registration or late return?

For online sellers "too late" means two different things.

Late registration concerns the start of the scheme. This article is about that.

Late return concerns the tax return after you are already registered. Here the member state of identification sends a reminder on the 10th day after the deadline. Further reminders and surcharges come from the country of consumption, which sets penalties under its own rules (European Commission). Whoever fails to file within ten days of a reminder three periods in a row counts as persistently non-compliant and is excluded. German law also provides for exclusion after repeated failure (§ 18j (6) UStG). More: missed OSS deadline and deregistering from the OSS.

Which mistakes come up most often?

  • Leaving registration until the return deadline. Registration comes first. Without it there is no return.
  • Entering the wrong date for the first supply. With "first supply" the day you crossed the threshold counts.
  • Missing the 10th day. After it, no retroactive registration is possible.
  • Overlooking the gap. Supplies before the start date are not automatically covered by the OSS.
  • Treating registration and return as the same. Each has its own deadline.

How VAT GPT helps

The guide to the BZSt registration form is in the app; you fill it in and send it in the BZStOnline portal. After that you proceed like this:

  1. Upload: You upload your Amazon or eBay CSV reports and your invoices. The AI reads amounts, countries and tax rates. VAT GPT flags invoices with low confidence for manual review.
  2. Check: VAT GPT separates German VAT from OSS VAT and breaks the sales down by country and VAT rate. You check and confirm.
  3. Send: With VAT GPT Pro, the OSS return goes directly to the BZSt.

Frequently asked questions

When does my OSS registration start? Normally on the first day of the calendar quarter after the application (BZSt).

Can I register for the OSS retroactively? Only in the exceptional case of a crossed threshold, until the 10th day of the following month. After that, no (BZSt).

What do I enter for "first supply"? The day you crossed the threshold (BZSt).

What applies to sales before the start date? You register in the countries of consumption and declare the VAT there directly (European Commission).

Is a late application rejected? An application made late in the quarter is not rejected, it simply starts later: on the first day of the next quarter (BZSt). The BZSt rejects participation only if the conditions are not met (§ 18j (3) UStG).

Does the 10th-day deadline also apply to the return? No. The return is due by the end of the following month: 30 April, 31 July, 31 October and 31 January (BZSt; § 18j (4) UStG).
